Capsunshop General Terms and Conditions of Sale

1. General Provisions
These General Terms and Conditions of Sale (GTC) apply to all orders placed through the capsunshop.com website.
They define the rights and obligations of Capsun Distribution & Web Design Sàrl, hereinafter referred to as “Capsunshop”, and its customers.
By placing an order, the customer acknowledges having read and accepted these General Terms and Conditions of Sale.
Capsunshop reserves the right to amend these General Terms and Conditions at any time. The version applicable to an order is the version in force at the time the order is confirmed.

2. Sales and Delivery Area
Capsunshop currently delivers exclusively to addresses located in Switzerland.
Orders with a delivery address outside Switzerland cannot be placed directly through the online shop.
For professional, commercial or distribution enquiries from abroad, customers are invited to contact Capsunshop so that possible delivery arrangements can be assessed on a case-by-case basis.
3. Products and Availability
Capsunshop makes every effort to present the characteristics, photographs, descriptions and prices of the products offered as accurately as possible.
Photographs and illustrations are nevertheless provided for information purposes only. Slight differences in colour, texture, dimensions or appearance may result from the materials used, the manufacturing process or the customer's screen display.
Offers are valid while stocks last.
If a product becomes unavailable after an order has been confirmed, Capsunshop will inform the customer as soon as possible and, depending on the circumstances, offer a replacement product, a new delivery date or a refund for the unavailable product.
4. Orders and Conclusion of the Contract
The customer selects the desired products and adds them to the shopping cart.
Before finally confirming the order, the customer may review the shopping cart, change quantities, remove items and correct the information entered.
The order summary displayed before confirmation includes, in particular, the products ordered, their prices and any applicable delivery charges.
Confirmation of the order and payment constitutes a binding offer to purchase and implies acceptance of these General Terms and Conditions.
After receiving the order, Capsunshop sends the customer an order confirmation by email.
Capsunshop reserves the right to refuse or cancel an order in cases including an obvious pricing error, product unavailability, suspected fraud, payment failure or clearly incorrect information supplied by the customer. In such cases, any amount already charged for the order concerned will be refunded.
5. Prices
All prices displayed on capsunshop.com are shown in Swiss francs (CHF).
Prices for customers in Switzerland include Swiss VAT where applicable.
Any preparation and delivery charges are shown separately before the order is finally confirmed.
Capsunshop may change its prices at any time. However, products will be invoiced at the price displayed when the order is confirmed, subject to obvious pricing errors.
6. Payment
The available payment methods are displayed during the checkout process.
Payment is made using the payment solutions offered on the website.
The order is considered finally accepted only after confirmation of payment by the relevant payment provider.
Capsunshop does not directly store the full payment card details used for transactions. These are processed by the secure payment service providers used by the online shop.
7. Delivery
Orders are delivered within Switzerland only.
Unless otherwise stated, goods are shipped by Swiss Post or another carrier selected by Capsunshop.
Delivery charges are shown to the customer before the order is finally confirmed.
The usual delivery time is 3 to 5 business days from confirmation of the order and payment, subject to product availability.
This delivery time is provided for guidance only. Delays may occur due to the carrier, unusually high order volumes, public holidays or other circumstances beyond Capsunshop's control.
The customer is responsible for providing a complete and accurate delivery address and contact details.
In the event of a significant delay, apparent loss or delivery problem, the customer is invited to contact Capsunshop so that an investigation can be carried out with the carrier.
The customer's statutory rights remain unaffected.
8. Receipt of the Order
The customer is invited to check the condition and contents of the parcel upon receipt.
Any damaged, incorrect or missing product should be reported to Capsunshop as soon as possible after discovery, preferably accompanied by photographs documenting the issue.
Capsunshop will review the situation and propose an appropriate solution.
9. Warranty
Products sold to consumers in Switzerland are covered against defects in accordance with Swiss law.
The warranty period is two years from the date of delivery of the product.
The warranty covers, in particular, manufacturing defects and defects that existed at the time of delivery.
The warranty does not cover, in particular:
- normal wear and tear;
- damage resulting from improper or non-compliant use;
- accidental damage, impacts or deterioration caused by the customer or a third party;
- modifications or repairs carried out without Capsunshop's prior approval;
- loss or theft of the product.
In the event of a defect covered by the warranty, the customer must contact Capsunshop so that the product and the appropriate solution can be assessed.
Any mandatory rights arising under Swiss law remain unaffected.
10. Returns and Voluntary Right of Return
Although Swiss law does not provide for a general statutory right of withdrawal for online purchases, Capsunshop voluntarily grants its customers a 7-day right of return.
The period starts on the date the goods are received.
Customers wishing to return a product must notify Capsunshop by email within this period.
To be accepted, the returned product must be:
- complete;
- unused and in perfect condition;
- in its original packaging whenever reasonably possible;
- returned with any accessories and documentation supplied with it.
Return shipping costs are borne by the customer, except where the return results from an error by Capsunshop or a defective product.
Once the returned product has been inspected and the return accepted, Capsunshop will refund the corresponding purchase price using the payment method originally used for the order.
Capsunshop may refuse or reduce the refund if the returned product has been damaged as a result of handling beyond what is reasonably necessary to establish its nature and characteristics.
Products that have been specially personalised or manufactured according to the customer's specifications may be excluded from the right of return where this is indicated before purchase.
The customer's rights in the event of a defective product remain independent of this voluntary right of return.
11. Exchanges
Where an exchange is accepted by Capsunshop, the applicable arrangements will be communicated to the customer on a case-by-case basis.
The product to be exchanged must be returned under the conditions applicable to returns.
Where there is a price difference between the products, the difference will either be invoiced or refunded accordingly.
12. Repairs and After-Sales Service
For any enquiry regarding a product purchased from Capsunshop, customers may contact the after-sales service at:

Depending on the nature of the issue, Capsunshop may ask the customer to return the product for diagnosis.
Where a repair is not covered by warranty, a quotation may be provided before any work is carried out.
Repair times depend on the type of product, the nature of the fault and the availability of any required parts.
13. Data Protection
Capsunshop processes personal data required for the management of orders, payments, deliveries, after-sales service and customer relations in accordance with applicable Swiss data protection legislation.
Detailed information concerning the collection, use, retention and, where applicable, disclosure of personal data is provided in the Privacy Policy available on capsunshop.com.
Personal data is used for commercial communications or newsletters in accordance with the customer's choices and the applicable legal requirements.
14. Liability
Capsunshop is liable for direct damages attributable to it in accordance with applicable law.
Capsunshop cannot, however, be held liable for consequences resulting in particular from:
- incorrect or improper use of the products;
- incorrect information supplied by the customer;
- events beyond Capsunshop's reasonable control;
- temporary unavailability of the website or third-party services where this is not attributable to Capsunshop.
Nothing in these General Terms and Conditions excludes or limits liability where such liability cannot legally be excluded or limited.
15. Intellectual Property
Texts, photographs, illustrations, logos, trademarks, graphic elements and other content available on capsunshop.com are protected by applicable intellectual property laws.
They may not be reproduced, used, modified or distributed without the prior permission of the relevant rights holder, except where permitted by law.
16. Applicable Law
These General Terms and Conditions and contracts concluded through capsunshop.com are governed by Swiss law.
The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded to the extent legally permissible.
Any mandatory consumer protection provisions remain unaffected.
17. Disputes
In the event of any difficulty, the customer is invited to contact Capsunshop first in order to seek an amicable solution.
If no agreement can be reached, the competent courts shall be determined in accordance with the applicable legal provisions.
