1. General information

The general terms and conditions of sale described below apply to all products and services sold through the capsunshop.ch E-Commerce site. They define the rights and obligations of the parties.
 Capsun Distribution & Web Design Sàrl reserves the right to modify the content and form of these general terms and conditions of sale at any time.

2. Personal data

Capsun Distribution & Web Design Sàrl undertakes to respect the confidentiality of personal data communicated by customers on the E-Commerce site and to treat them in accordance with legal obligations.
 Customer data may be used by Capsun
 's internal departments:

  • For the processing of orders, deliveries and invoicing 
  • To inform about upcoming sales and events by sending invitation emails
  • To strengthen and personalize communication with your customer, including sending newsletters, special offers and other emails.

 

The customer undertakes to provide the personal information necessary to manage his order (delivery and invoicing). These must be correct, valid and up to date. Information relating to his identification and password must be kept secret by the customer.

3. Sales process

3.1 Orders

Once the desired product is selected, it is placed in the "shopping cart" by the button "Add to cart". The customer can then continue his selection of items, modify his shopping cart or continue the process of his order and pay.
 The validation of the order by the customer constitutes acceptance of the general terms and conditions of sale.
 Once the order has been validated and paid for, the customer receives an order confirmation information by email.

 

3.2. Prices

The prices mentioned per item on the E-Commerce site are indicated all taxes included and excluding preparation or logistical delivery costs. The shipping costs of the order will be indicated before the final validation of the order.
 Capsun reserves the right to change the prices and other charges displayed on the E-Commerce site at any time without notice. However, the products will be invoiced to the customer on the basis of the rates in effect at the time of validation of the order.
 The customer benefits from the prices mentioned per item, valid in the country for which he can indicate a delivery address.

 

3.3. Product representation

Capsun undertakes to make the necessary efforts to ensure that the photographic representation of the products and services offered for sale on the E-Commerce site is as accurate as possible. However, with regard to the way these products are presented on the Internet, it is possible that the customer's perception of the photographic representation of the products does not correspond exactly to the products themselves.

 

3.4. Secure payments

Payment for purchases is made by means of payment cards. 

For customers delivered in Switzerland, payment by Post Finance is also possible.
 The order will be considered effective after confirmation of the agreement of the bank payment centres. 

In accordance with current regulations, and to ensure the security and confidentiality of their information, Capsun does not store its customers' banking data. It is therefore the customer's responsibility to save and print his payment certificate if he wishes to keep the payment details relating to his order. The
  payments managed by the Capsun
  E-Commerce site are subject to a security system of the highest level to date: PCI DSS level 1 certification. This international standard, established by the main market players (MasterCard, Visa, American Express, Discover Financial Services and JCB) governs the security requirements for international payments:

 

  • Setting up and managing a secure network
  • Cardholder Data Protection
  • Implementation of a vulnerability management program
  • Implementation of effective access control measures
  • Continuous monitoring and testing of networks at regular intervals
  • Establishment of an information security policy

 

3.5. Shipping & Returns

Shipping costs are calculated at the end of the order, according to the destination country, the weight, volume and tariffs of the carrier in charge of the delivery. 

 

Capsunshop handles the preparation and the deposit at the postal service of the goods sold through the E-Commerce site. Except contrary indications, the shipments in Switzerland and abroad are sent by the Swiss postal service "Economy" then taken care by the distribution service of the country of destination of the customer.

The products and/or services will be sent to the delivery address that the customer has indicated during the ordering process.

The customer is responsible to provide detailed and valid information concerning the delivery address of the goods and contact information in order to avoid any delay of delivery, loss or return of the goods by the postal service. Capsunshop cannot be held responsible for any delay in delivery or loss of merchandise.

As from the order and the confirmation of the payment, the delivery periods are as follows:

- 3 to 5 working days for Switzerland

- 7 to 15 working days for Europe

- 10 to 20 working days for the rest of the world

These delivery times are given as an indication for a shipment in "Economy" post and may vary depending on the situation and the type of shipment chosen at the time of order and other factors beyond our control.

As soon as the delivery is made, the invoice will be available on the E-Commerce site.

3.6. Guarantee

The international warranty is for one year (2 years for products sold in Switzerland) and covers products against manufacturing defects or hidden faults. It does not cover natural wear and tear of the product, accidental damage or damage caused by improper use, shocks or loss of the product.

 

3.7. Returns, retraction and refund

As from the reception of the product by the customer, he has a right of retraction, i.e. a period of 7 days to notify by e-mail and to return the delivered product, the return costs being at his expense. Only products purchased through the E-Commerce website and returned intact and complete in their original packaging (with labels with their references), accompanied by the delivery note may be refunded. In the case of an exchange order, the shipping costs of the new order will be offered.

 

3.8. Repairs

The customer can contact Capsun Customer Service by email for any information or repair quote request for products purchased through the E-Commerce site.

Only products purchased through the E-Commerce website and returned intact and complete in their original packaging (with labels with their references), accompanied by the delivery note may be repaired. The repair time is announced by Customer Service on a case-by-case basis.

4. Applicable law

These general terms and conditions of sale, as well as any sale to which they apply, are subject to Swiss law. Any dispute arising out of or in connection with these general terms and conditions of sale or any sale to which they apply shall be settled in accordance with Swiss law, whether such dispute is of a contractual or tortious nature, or whether it is based on another clause. The application of the 1980 United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

5. Disputes

By accepting these general conditions of sale and by validating the order, the customer commits himself to assume the risks due to an online order on this e-commerce site, like delays of delivery, loss of the goods or any other problems inherent to an online order. In case of dispute, Capsunshop is at the disposal of the customer and commits itself to find a fast solution in order to satisfy both parties.
